The User hereby provides explicit, informed, and unconditional consent to such cross-border transfer and processing of personal data. The User acknowledges that data protection laws in such jurisdictions may differ from those in India and may not provide the same level of protection. Notwithstanding the same, Glocal undertakes to implement reasonable safeguards, contractual protections, and standard data protection practices to ensure that personal data is handled securely and in accordance with applicable laws, to the extent reasonably practicable.
Glocal shall retain personal data only for as long as necessary to fulfill the purposes for which it was collected, including the provision of services, completion of applications, and ongoing client support. In addition, data may be retained for extended periods as required for compliance with applicable laws, regulatory requirements, contractual obligations, audit purposes, internal record-keeping, fraud prevention, enforcement of legal rights, and resolution of disputes. The User acknowledges that even after termination or completion of services, Glocal may retain relevant data for such lawful purposes, and such retention shall not be construed as a breach of privacy or misuse of data.
Glocal implements reasonable and industry-standard technical and organizational measures to safeguard personal data against unauthorized access, misuse, loss, alteration, or disclosure. Such measures include, but are not limited to, secure CRM systems, role-based access controls, authentication protocols, encryption mechanisms, secure storage systems, internal data protection policies, and confidentiality obligations binding on employees, agents, affiliates, and service providers. Access to personal data is restricted strictly to authorized persons who require such access for legitimate purposes.
Notwithstanding the above, the User expressly acknowledges and agrees that no system, network, or method of electronic storage or transmission over the internet is completely secure or immune from risks. Accordingly, Glocal does not guarantee absolute or error-free security of personal data and shall not be held responsible for any unauthorized access, data breach, loss, leakage, or disclosure arising from events beyond its reasonable control, including but not limited to cyber-attacks, hacking, system vulnerabilities, technological failures, force majeure events, third-party breaches, or acts or omissions of external entities.
Without prejudice to the foregoing, the User agrees that, to the maximum extent permitted under applicable law, Glocal’s liability in relation to any data breach, data loss, or unauthorized access shall be limited strictly to cases of proven gross negligence or wilful misconduct directly attributable to Glocal and supported by credible evidence. In any event, Glocal shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of opportunity, loss of data value, loss of reputation, or financial loss arising from such incidents. Further, the aggregate liability of Glocal, if any, shall in no circumstances exceed the fees actually received by Glocal from the User for the specific services in connection with which the claim arises.
This clause shall be read harmoniously with the provisions relating to consent, data sharing, confidentiality, and limitation of liability, and shall survive termination or completion of services to the extent necessary for compliance, enforcement, and protection of Glocal’s legal and commercial interests.

While Glocal undertakes to maintain confidentiality, the User acknowledges that no system is entirely immune to risks, and Glocal shall not be liable for any disclosure or breach arising from events beyond its reasonable control, including but not limited to cyber incidents, force majeure events, or acts of third parties, provided reasonable safeguards have been implemented.
